Vindication???

Christmas1996. I was not preparing for a holiday cruise with my family. I wasnot preparing to give my housekeeper a check for over a thousanddollars. I had not hired Santa to entertain children at my annual Christmas party.
No, I wasn't doing any ofthese things. I was futilely making my best efforts to collect all thetorn wrapping paperfrom everywhere in the house - including from the mouths of severaldogs who were seemingly intent on producing copious amounts of homemadeconfetti.
Iwas also endeavoring to keep my older son from putting his littlebrother in the trash can. After rescuing my second son from thegarbage, he looked up at me and said, "Poor tired Mommy. Can I help?"My response? "How about you find a relatively clean glass, pour twofingers of bourbon in it, and bring it to me?" I wasn't joking.
I've never been at risk ofbeing named "Mother of the Year."
Interestinglyenough, however, I appeared to be at risk of murdering my children. Allbecause of a family 1500 miles away whose child had been brutallykilled. A family that had absolutely zilch in common with mine.
Granted,this outside interest in my family was brought on with the help of acorrupt juvenile court judge who just unfortunately happened to be ablood relative.
Waybefore I became so jaded that it's impossible for me to be shocked byjust about anything, I remember shaking uncontrollably as I was toldthat DFACS (ChildProtective Services in Georgia) was going to "keep an eye" onme because of Jon BenetRamsey's murder.This was not my first experience with DFACS. Shortly after my secondchild was born (yes, Benjy the toddler bartender) I was investigatedfor child abuse after I wasaccused of being a lousy cook. Seriously.
So you see, my family wasnothing like the Ramsey family. In particular, I was nothing like Patsy Ramsey. I rememberwatching her on CNNand thinking, "This woman looks more put together at her child'sfuneral than I did on my wedding day!"
Butfor all the differences between us, we have one important thing incommon: Both the Ramsey family and the Baez family have been accused ofhorrific and unspeakable acts of abuse and violence toward our ownchildren.
Iwas lucky to survive the false accusations against my family. Granted,I have some health issues that will probably never go away - but I'mstill standing. One of my children is an adult now and the other one isnot too far behind.
TheRamsey family, on the other hand, is not still standing. Their entryinto the world of the falsely accused began with the brutal murder oftheir child. They have been publicly vilified and been followed forover a decade by a dark cloud of whispered (and sometimes not sowhispered) accusations and suspicions.
Everyone of us who has been falsely accused of child abuse is owed anapology by our accusers and by those who did their bidding. I won't beholding my breath waiting for my family's apology. But let's make surethat the Ramsey family is close to the top of the list.

AFRA not a "Competitor"
It has come to our attention that American Family Advocacy Center (AFAC) in Colorado is referring to American Family Rights Association (AFRA) as a "competitor".
AFAC apparently claims to be a "for profit" organization offering "consulting" and "licensing of copyrighted intellectual property".
AFRA, a non profit ASSOCIATION of family rights advocates, interested individuals, and CPS victims, clearly has NEVER, and does NOT desire or intend to "compete" with AFAC.
Both AFRA member advocacy groups and non-member advocacy groups are perfectly free to operate on their own.  
AFRA does NOT impose in any way on any family rights advocate, beyond the suspension of their AFRA membership if they commit egregious or unprofessional acts that injure clients or behavior that reflects poorly on AFRA.  Even such suspended members are NOT "pursued", harassed, or defamed, or made victim of a character assassination.
If independent advocates WANT help from AFRA, we will provide what we can and only what we are asked to provide.
Stated as clearly and as succinctly as possible, AFRA, being an ASSOCIATION of family advocates, does NOT, and will never "compete" with any "family advocate" organization or individual, AFRA member or not, in any way, shape, or form.

Hello everybody! Just wanted to update y'all on what's going on......

A number of times this season I have been bitten by large numbers of fire ants, which I'm allergic to. As happened once before this has caused scalded skin syndrome (also known as Ritter's disease). The previous time, at age 3, every bit of my skin just came off. This was in the early 70's when toxic reactions like this were not completely understood. I almost died while various doctors tried to figure out what was wrong with me. Luckily my mother was only briefly suspected of burning me herself, so we didn't have to go through accusations and separation.

I'm not totally out of commission but have low grade fever and really unpleasant body aches, not to mention pain from the burns. Nothing life threatening at all this time around. The reason I'm writing about this in such detail is because of the misdiagnosis/child abuse accusation angle.

I'd like everyone who is or would like to be involved in Family Advocacy to know that this is a condition most common in children pre-school age or younger. (But since I already had it, I win again.) Scalded skin syndrome is often mistaken for child abuse, as there are actual burns on the body and nobody believes at first it had anything to do with insect bites - basically you burn from the inside out.

It's not uncommon for the parent to be unable to pinpoint the onset...to use myself as an example: I was bitten almost constantly over a period of time, scratched and cussed, and didn't suspect anything worse until I started to see the burns. It's important to lead the parent gently backwards to pinpoint the exposure - this is important in the case of an accusation. Parents need to insist that their child be tested, and advocates and others can be a great source of support to the whole family.

Responses to my 4/24 letter to the editor

On April 24, The Augusta Chronicle published a letter to the editor that I had written. This letter had 43 web comments. There is one particular comment that I am going to address here.

The images we have all seen of the families involved in the Texas polygamy case are disturbing. It doesn't matter where one's opinion lies -- the whole situation is simply disturbing.

I would not agree to live in a plural marriage, no matter how often my husband jokes about finding another wife. But I do believe that people should be able to choose their lifestyles. I am strongly in favor of changing our marriage laws to provide gays and lesbians the chance to marry. In my mind, polygamy is not all that different as long as the marriage partners are consenting adults.

Unfortunately, at issue in the Texas case is not only freedom of association, but accusations that children are forced into arranged marriages. It is interesting to note that Child Protective Services in Texas decided that accusations of teen girls being forced to marry justified the detention of more than 400 children, some of them infants . According to CPS' own information, 90 percent of the children detained were in no imminent danger. It is for this reason that I'm crying "foul."

Over the past decade, I have seen some extraordinary silliness in CPS cases, usually perpetrated on families who are ill-equipped to fight back. If you stand by and say nothing as multiple families are torn apart, then you may find yourself on the receiving end of the same bitter medicine with no one to speak out for you.

And here is the comment with my responses.

Mrs Baez: For YOUR information, ANY TIME ONE CHILD IN THE HOME IS SUBJECTED TO SEXUAL EXPLOITATION, ALL OF THE CHILDREN ARE, ESPECIALLY WHEN THE MOTHER WILL NOT PROTECT HER CHILD.

At this point, no abuse has been proven in court. Child Protective Services (CPS) are using the "risk of harm" argument as justification for detaining all of the children.

Also, I disagree with your basic premise that all children are sexually abused just because a sibling is.

If you remove the victim and leave the others in the home, then there is a new victim. (The caps are for emphasis, not shouting).

As I stated above I disagree with your basic premise.

The Texas authorities have acted in the best interest of the children and have not only legally, but rightfully, removed any potential victim.

Actually, it is not lawful to remove a "potential" victim. Federal law requires that "reasonable efforts" (Congress's words, not mine) be made before detaining a child away from his or her home. Reasonable efforts must also be made to make it possible for a detained child to be released.

The reason the "parents" are lying is because they know and understand that they have broken the laws regarding overt sexual behavior towards a child.

Where have the parents lied?

Those "men" are nothing more than perverted pedophiles who, if living in any other city or town, would have been arrested and prosecuted. The men who fathered these children have left the area in order to circumvent the law. Arizona and Colorado would do well by raiding those FLDS compounds.

Then how do you explain the presence of all those men still at the ranch?

Also, are you saying that anyone who has sexual relations with a girl under the age of 18 is a pedophile? Young people have sex all the time, often VERY casually. It seems to me like you're taking a single kumquat and trying to split it in half and then call it an apple and an orange.


How would you like it if your 13 year old was impregnated by your pastor because he believed he is "spiritually authorized by God?" Some of these children are now products of incest, which is also against the law.l Imagine the medical problems they will develop in the future.

I don't think my just turned fourteen year old would sit still long enough for anybody to impregnate him.

Seriously, we are talking about arranged marriages as part of an alternative lifestyle. Sure, I'd take issue about ANYBODY being forced into any marriage. But as far as I understand the situation in Texas, we don't know for sure that this is the case.

Time will tell.

Notice From Jack Stratton

On March 16, 2008 WBT talk show host Jeff Katz had my opponent Sue Myrick on his show from 5-6 p.m without giving our campagn equal time.

On April 17, 2008 Katz again had Myrick on his show without giving our campaign equal time.

Katz and WBT are in violation of federal election law (47 USC § 15).

On April 29, 2008 I faxed a NOTICE AND DEMAND to Greater Media, Inc., the parent corporation of WBT. I advised them to cease and desist from their violation of federal law.

Greater Media ignored my demand and continued to violate federal law.

Yesterday, April 30, 2008, I sent an overnight express, certified mail, to Greater Media, Inc. advising them that their continued violation of federal law would not be tolerated and that they were jointly and severally liable. They received the certified complaint and demand no later than 12:00 p.m. today, April 30, 2008.

At approximately 3:30 p.m. today, April 30, 2008, my wife received a phone call from a Mr. East at WBT. Mr. East stated that WBT would put us on the Jeff Katz show from 4-5 p.m. on Friday, April 2, 2008 or on Monday April 5 from 4-5 p.m.

Perhaps WBT and Jeff Katz should have heeded the words of one of their talk show hosts, John Hancock:

"...if they have taken advantage of this family and they thought they were just going to railroad this dumb putz, they found out they picked the wrong guy, and this dumb putz isn't a dumb putz."

We are currently contemplating our legal options. One thing is certain: Jack Stratton knows how to get things done. Look for us tomorrow or Monday on WBT.

Recording conversations, and other interactions with idiots.

Well, this is yet another ranting post about the Family Rights movement....specifically Suzanne Shell.

It all started early this morning when I responded to a post on the Child Protection Reform Yahoo, Group.

The post I made had to do with the laws governing recording conversations and the various state laws. I responded to this post with the following:

  • It's important to remember that an argument can be made that
    government employees do not have the same expectation of privacy that
    would apply to private citizens.

    I have seen families get away with hidden taping in "all party states"
    by using this argument.

    I am not an attorney and this is not legal advice, just an observation.

Then out of the blue, here comes Suzanne "I invented Family Advocacy and own copyrights to everything up to and including the Bible" Shell making this comment on her group:

  • I am not a member of child protection reform - my request was denied - so I will respond here to the message posted by D Baez (Your request was probably denied because you have a tendency to be disruptive, and basically rude and obnoxious. We've been over this before when I had to deny you membership in a group I moderate. -DKB)

    Yes, after I researched the issue and found that public servants have no expectation of privacy in the performance of their duties, I wrote and published a Memorandum of Law Documenting (Recording) Public Officials on her web site which clearly details the reasons why you can record a case worker without notifying them regardless of the wiretapping or recording laws. (Never read it, sorry. The world doesn't revolve around you. Get over it. - DKB)

    Thank you so much, Ms. Baez, for providing another sterling example why I stopped freely publishing my work online, because of YOUR propensity, and AFRA's insistence on claiming credit for work you did not do and/or for not attributing credit where it is due. (This is where Shell accuses me of theft. -DKB)

After I read the post above, I made a mistake. I tried to email the moderator of the group about this latest accusation and instead sent my message to the group. I quickly apologized and deleted the message. To be clear: I stand by what I wrote, but I still maintain that it was inappropriate for the message to be sent to the whole group.

I have reproduced that message here:

  • Jane, Suzanne Shell is claiming that I stole something she wrote about
    taping government agents. I didn't know until just now that she
    claims to have originated this idea. My own recollection of Shell's
    statements on taping are that suggested quite a different method.

    Actually, my interest in exceptions to taping laws began as much of my
    advocacy strategies do - by the seat of my pants. I had a mom who
    taped a police officer in an all party state and was threatened with
    arrest. On the spur of the moment, I had to speak with a supervisor
    and explain why this mom shouldn't be arrested. I used the "public
    official does not have an expectation of privacy" argument. It
    worked. Then, once I caught my breath, I did the research to back it
    up. This was a really long time ago, before I quit even talking to
    families if they weren't in Georgia - therefore according to my
    memory, this would have had to be pre-2001.

Mine , of course, resides in the U.S. Copyright office which, incidentally, supersedes any unreliable and non-documented "memory" claim you are attempting to foist on the unsuspecting public. And, should that proof fail to convince, naturally, we can resort to dueling file creation dates and email dates proving the earliest creation dates. (Oh, blah blah blah. I stand by my statements. Considering your behavior these past several years, I think I'll count on being the one who is more credible. Why don't you sue me? Seriously. -DKB)

    Care to take me on - here on this group? Or are you wiling to concede and properly attribute the source of that concept and document to the rightful author? I would suspect, not. True to your nature, you will take your complaint behind my back and dare not attempt to prove it here. That is your MO, isn't it?

You'd think, knowing she is targeted by CPS and the subject of repeated interventions, she'd keep her act clean. Curious why she didn't. Any comments? Disavowals? Excuses? Nah. . . too embarrassing to talk about, right? (Embarrassing? How about totally off topic. You're trying to create a straw man argument to redirect my focus away from responding to your accusations so that you can then say that I "avoided" giving an answer. I know how you operate. And Cheryl Barnes and her unfortunate situation has about as much to do with me as the price of crystal meth down on Broad Street.)
